Terms of Agreement
Notice of Default: Should you default in your payment obligation, you agree to pay all costs of collection, including court costs and attorney’s fees.
Notice to Recipient:
Do not sign this membership Agreement before you have read ALL of the Rules and Regulations, as well as the AGREEMENT TO HOLD HARMLESS attachment as this is part of this Agreement.
The Member is entitled to a completely filled in copy of this Agreement and Rules and Regulations. The Member acknowledges that they have been told: (A) That this document is an Agreement and will become legally binding upon its acceptance by Gym Rat Fitness. (B) The terms and conditions of this Agreement; (C) that they acknowledge that they have examined the facility and equipment; (0) there are no warranties either expressed or implied which extend beyond this Agreement.
Member(s) agree to receive regular communications by email from alphacompanygym@gmail.com of which they can unsubscribe from at any point.
Rules & Regulations
The Member agrees to abide by all rules and regulations of Alpha Company Gym now in effect or to become effective at any future date. The hours of operation will be set as a 24 hour/7 day a week facility for Members only. Alpha Company Gym may change its hours at its sole discretion. In addition, Alpha Company Gym reserves the right to make or to change reasonable rules and regulations for the operation and use of the facility. Further, Alpha Company Gym expressly reserves the right to add to, eliminate, or alter any program or equipment when deemed necessary or desirable, if in Alpha Company Gym’s judgment it is in the best interest of the members and/or the business in general.
Alpha Company Gym may revoke the Membership for the Member’s substantial breach of Alpha Company Gym rules and regulations or generally undesirable behavior which shall be at the sole discretion of Alpha Company Gym f. No one under the age of 18 will be permitted in the facility unless accompanied by an adult.
Entire Balance Due: If you do not make payment when it is due Alpha Company Gym can/will suspend your membership privileges and require you to pay the past due balance of what you owe as stated above.
Gym Access: There will be a one time card fee charged to obtain an access keychain or key card to the gym. If you lose your keychain or key card and need to obtain a new one will require an additional $15.00 per item.
Lockers: Alpha Company Gym is not responsible for any items lost or stolen from the lockers. If you wish to use a locker please choose your number and inform management of the number and provide your own lock.
Default: You will be in default if you do not pay Alpha Company Gym as required under the terms of this Agreement and are delinquent for one or more months of dues. Alpha Company Gym may get a court judgment against you to collect all dues contracted during the term of membership and collect penalties and late fees that apply. You agree to pay any court costs against you for what you still owe and any court costs and reasonable attorney’s fees involved in collecting this Agreement. Interest shall accrue at 15% per annum as of the date of this Agreement for all unpaid balances.
Fees for Returned Funds: If any payment under this Agreement is returned on the first presentment, you will be charged a $25.00 returned check fee, $25.00 for any credit card or EFT payment which are not honored for any reason, and any late fees and penalties that apply to any of the above.
Medical Condition: You may cancel with 30-day written notice if you become permanently disabled and thereby cannot use the facility, or your estate may cancel in the event of your death. You must prove such disability by a doctor’s certificate.
If a member is injured at or around the wellness center including the parking lot, an accident report must be filled out immediately. Membership may be frozen due to medical emergency only. Doctors written notification required. Minimum freeze period is 30 days.
THE MEMBER REPRESENTS THAT THEY HAVE NO CONGENITAL, PHYSICAL, OR MENTAL HEALTH PROBLEMS THAT WILL PRECLUDE PARTICIPATION IN GYM MEMBERSHIP. SPECIFICALLY, THE MEMBER REPRESENTS THEY HAVE NO UNDERLYING CARDIOVASCULAR, NEUROLOGICAL OR ANY OTHER ILLNESS THAT WILL PRECLUDE PARTICIPATION IN THE GYM MEMBERSHIP. IF YOU DO, DO NOT SIGN THIS AGREEMENT.
Month to Month Members: Month to month membership can stop at any time. You may not however receive any credit for unused time.
Family Membership: If one of the members of a family membership does not pay his half of the family membership, the family membership will be downgraded to a single membership for each person.
How and Where to Notify Alpha Company Gym of cancellation (contract members only): To cancel for any reasons above you must send 30-day written notice prior to monthly dues date, by certified mail or by personal delivery tell Alpha Company Gym that you are cancelling to business address.
Damage: All participants and Members agree to be responsible for any and all damage caused by participant/member to the premises or equipment that is caused by negligent or careless behavior.
Trespassing: No member will allow access to others that are not members. All members must have their own access to enter. If you want to bring a friend to check out the gym please notify management prior and they will be permitted a free one day trial.
Fighting: Any member that is involved in an altercation while at Alpha Company Gym will have their membership suspended and may face criminal prosecution.
Cameras: Alpha Company Gym uses event cameras to record events within the Gym. These cameras and any videos that are recorded are the sole property of Alpha Company Gym and are not here for your protection or use. The member consents to be videoed while in the gym. All video will be in accordance with all applicable laws.
Equipment Failures: All members agree to look at all the equipment before use to insure its usability. If a member sees that a piece of equipment is in need of repair they will contact the management immediately and place an out of order sign on the equipment so it may be fixed.
Non-Member Access: Members are allowed to let a friend try out the gym but Alpha Company Gym staff needs to be contacted prior to their tryout, again for yours and their safety so they are not tagged as having unauthorized access and being considered a trespasser. If a member is caught bringing someone in that is NOT a member, your membership will be revoked and you will be banned from the gym indefinitely.
Agreement to Hold Harmless
BY SIGNING THIS AGREEMENT YOU UNDERSTAND AND AGREE to HOLD HARMLESS Alpha Company Gym, its Members, its agents, and its employee’s. They will not be responsible for any injury (or loss of property) suffered while participating at Alpha Company Gym using equipment, or are on the club premises, for any reason whatsoever, including but limited to ordinary negligence on the part of Alpha Company Gym , and it’s Owners, it’s Members, it’s Agents, and it’s Employee’s.
By signing this agreement you are stating that YOU UNDERSTAND AND AGREE to, and will abide by the following:
- THE AGREEMENT APPLIES TO ALL MEMBERS, AND VISITORS. THIS WILL BE IN FORCE AT ANYTIME THAT YOU ARE AT THE FACILITY, WHETHER WORKING OUT OR NOT.
- Activities that you will be able to do at Alpha Company Gym are physical in nature.
- Activities at Alpha Company Gym involve RISK AND CAN BE/ARE DANGEROUS, including but not limited to, DEATH, DISFIGUREMENT, SERIOUS NECK, SPINAL AND BACK INJURIES WHICH COULD RESULT IN DEATH OR COMPLETE OR PARTIAL PARALYSIS, HEART ATTACK, INJURIES TO BONES, JOINTS, MUSCLES, TENDONS, AND ANY OR ALL OTHER PARTS OF YOUR BODY.
- You AGREE that you are VOLUNTARILY PARTICIPATING AT ALPHA COMPANY GYM. In various activities with the KNOWLEDGE AND UNDERSTANDING OF THE DANGERS THAT ARE INHERENTLY INVOLVED with the activities associated in a gym.
- You UNDERSTAND AND AGREE that the nature of the 24/7 facility, like ALPHA COMPANY GYM, means that ALPHA COMPANY GYM DOES NOT PROVIDE ANY TRAINING OR GUIDANCE IN YOUR ACTIVITIES. THIS MEANS THAT YOU WILL NEED TO BRING A FELLOW MEMBER WITH YOU AT ALL TIMES TO INSURE YOUR SAFETY. ALPHA COMPANY GYM WILL NOT HAVE AN EMPLOYEE OR REPRESENTATIVE PRESENT AT THE GYM AT ALL TIMES. WE PROVIDE NO SAFEGUARDS FOR YOUR SAFETY. YOU ACCEPT AND UNDERSTAND THAT YOU ARE FULLY AND TOTALLY RESPONSIBLE FOR YOUR SAFETY WHILE PARTICIPATING AT ALPHA COMPANY GYM.
- You further UNDERSTAND AND AGREE to act in accordance with all safe exercise habits and follow the rules set forth by Alpha Company Gym while participating and HEREBY COVENANT NOT TO SUE AND RELEASE ALPHA COMPANY GYM, its owners, its employees, instructors or agents, FROM ANY AND ALL PRESENT AND FUTURE CLAIMS RESULTING IN INJURY FOR ANY REASON and all claims arising as a result of engaging in ANY ACTIVITIES UNDER ANY CIRCUMSTANCES AT ALPHA COMPANY GYM.
- We are not in any way liable or responsible in regards to any personal trainer you may hire whether they are recommended or not.
- We are not responsible for any vehicles or any vehicle damage incurred while at ALPHA COMPANY GYM.
- You swear and attest that you are not an agent or acting on behalf of any other Gym, Health Club, Athletic Facility, and/or any other related company, business or organization. You further attest that you are NOT using our facility for research or any other purpose but for your use and enjoyment.
BY SIGNING THIS AGREEMENT IT MEANS THAT YOU UNDERSTAND AND AGREE BY BECOMING A MEMBER AND/OR USING THE FACILITY THAT YOU MAY BE HURT, KILLED, OR INJURED IN SOME WAY AND THAT YOU WILL NOT SUE GYM ALPHA COMPANY GYM FOR ANY INJURY OR LOSS YOU MAY INCUR FOR ANY REASON AT ANY TIME.
THIS MEANS THAT YOU ARE AGREEING TO GIVE UP YOUR LEGAL RIGHTS TO SUE, AND YOUR FAMILY MEMBERS LEGAL RIGHTS TO SUE ALPHA COMPANY GYM, ITS MEMBERS, ITS OWNERS, ITS AGENTS, AND ITS EMPLOYEES. ALPHA COMPANY WILL NOT BE RESPONSIBLE AND OR LIABLE TO THE PARTICIPANT OR THE PARTICIPANT’S FAMILY WHATSOEVER IN RELATION TO PERSONAL INJURY OR PERSONAL LOSS OF ANY KIND.
YOU FREELY AND WITH FULL UNDERSTANDING DO AGREE TO HOLD ALPHA COMPANY GYM HARMLESS AND ACCEPT THE FACT THAT YOU CLAIM ULTIMATE AND FULL RESPONSIBILITY FOR YOUR SAFETY WHILE AT THE FACILITY.
This Agreement is not cancellable and is not transferable for any reason whatsoever, except as herein provided; and not subsequent modification of the Agreement may be made except in a written agreement by all parties.
Failure of the Member to utilize the 9. You swear and attest that you are not an agent or acting on behalf of any other Gym, Health Club, Athletic Facility, and/or any other related company, business or organization. You further attest that you are NOT using our facility for research or any other purpose but for your use and enjoyment.
Failure of the Member to utilize the Alpha Company Gym facility for any reason other than stated in the above section of this Agreement, SHALL NOT relieve the Member from the obligation to make any payment required to be made by the Member pursuant to the Contract Agreement.
I agree and attest that by signing this agreement that I accept this agreement in its entirety. I further agree that I will uphold the commitment as stated in the membership type.
Membership Cancellations
Members agree to the contract terms at the time of purchase. Alpha Company Gym agrees to abide by the following refunds / returns policy:
Early Cancellations result in a Penalty Fee and current fees are noted on the Membership Agreement. Members can manage subscriptions from the web and easily cancel anytime. Alpha Company Gym will cease charges upon cancellation and members access to gym will end immediately. Renewals are subject to gyms current pricing and fees.
